Why have an Asbestos Survey done now?
Since 2002 legislation came into force whereby non-domestic properties must be assessed for asbestos. It is the duty of building owners, tenants and any other parties who have any legal responsibility for the premises to manage the risk from asbestos that may be present in the building.
You are required by law to ensure that a suitable and sufficient assessment is carried out as to whether asbestos is or is liable to be present in the premises.
A specialist asbestos survey of the property is required to fulfil this mandatory requirement.
The HSE have stated that they intend to vigorously enforce this legislation. Non-compliance is now a criminal offence punishable with fines of up to £20,000 and imprisonment of up to 6 months, per offence.
Just because asbestos is present within a building does not mean it has to be removed. Asbestos materials in good condition, can be safely managed without the need for costly removal or remediation. Government 150% Tax Relief Scheme
Financial help is available. "The tax relief initiative” is a major financial impact benefit for both property owners and businesses. As part of the urban regeneration scheme, the government has introduced a 150% tax relief for companies incurring expenditure on land remediation, including buildings. So now the costs of asbestos removal/management from existing buildings can be set against company profits as tax relief.
The Control of Asbestos Regulations 2006 came into force on 13 November 2006 (Asbestos Regulations - SI 2006/2739). These regulations clearly outline the methodology associated with surveying properties with asbestos containing materials (ACM's).
We offer three types of asbestos survey:
Type 1: Asbestos and Assessment Survey
This presumptive survey is designed to locate the presence and extent of any suspect ACM's in a given building where practicable. We visually inspect the building to identify materials that may contain asbestos and supply a clear outline of our findings. Sampling and anaysis can be defered for another time.
Type 2: Standard Sampling, Identification and Assessment Survey
This survey takes all the consituent elements of type 1 except that representative samples are taken and analysed for the presence of asbestos. The subsequent report issued includes an outline of ACM's found and recommendations regarding their management.
Type 3: Full Access Sampling and Identification Survey
This survey takes all the constituent elements of types 1 and 2 but adds destructive testing where appropriate, and access to all areas including areas where accessibility is difficult to reach. A full sampling programme is undertaken to ascertain the full extent of ACM's and calculations are made to establish the volume and surface area of it. This survey is designed to be used as the basis for a tender enquiry prior to demolition or major refurbishment work.
